Yes, 60 mm mortars are NFA Destructive Devices.  Additionally, AFAIK, California requires a CA DOJ permit to own one.

Are they only avalible from private sellers or can they be purchased new or home built.

AFAIK, there's not a manufacturer FFL making them right now.  You could buy one from a private owner or you could get an approved Form 1 and then put it together.  If you're in California, I understand you will also need to get an approved California DOJ permit for a destructive device.  I have a NFA registered 60 mm mortar but it is not for sale.

AFAIK, it's a seller's market.  The components include mortar tube, mortar base cap, firing pin, bipod, base plate and sight.  The base cap is a Title 1 firearm until it is mated to the tube.  That makes it a NFA / Title II item.  Training rounds are available at $150 each (fins and inert nose cone included) from Big Sky Surplus (Spokane, WA).

My 60 mm mortar training rounds do not contain explosives.  Here's a link to a gratuitous photo to one of my motivational posters: http://www.imageseek.com/m1a/gallery/albums/Differents-Motivational-Posters/Old_School.sized.jpg
