So I jumped into the NFA game with the purchase of two cans back in June with a NFA trust through the Silencer Shop. I just checked the status of my transfers on their page and it says
Form 3 Status: Approved 1/13/2017 Form 4 Status: Submitted 7/5/2016 So what is the Form 3, and what does this mean about the status of my purchase? Should I be expecting to get my cans out of jail in the near future? I know a form 1 is and the form 4, but whats the form 3? |
| Form 3 is the Form for the transfer of the NFA item from one dealer to another dealer. So in your case, from SS to your dealer in WA. Rumor is Form 4s are taking around 12 months, so I wouldn't get excited until this Summer, if it happens sooner it'll be an awesome surprise. |

So my suppressors might be at the dealer here?
My dealer will allow you to shoot your cans on their range while they are in jail, you obviously just cant leave the shop with them. ETA: SS stats say average of about 250 days from purchase to stamp received. So I'm in the ball park to receive my stamps in the next month or so? |

Looking back through my emails, The last response to an inquiry I got from them was in September:
We have submitted the form 3 for both suppressors. The initial was submitted on 6/4/2016 and was lost by the ATF we resubmitted on 8/4/2016. Once we get the form 3 approved we will ship to the dealer. The ATF has cashed the tax checks for both on 7/13/2016. So I would expect to see the approval in December or January. So, once the form 3 is approved, and the cans are shipped to the dealer, how long is the average wait time to receive the stamps and you can get your cans out of jail? edited for spelling |

I had two approved 1/24 (stamp received yesterday, 2/3) that were submitted mid-May 2016. I dunno how those dudes work, but it's early February and they're getting to stuff that was submitted May of last year...it'll probably be what, like May or June before they make it to June/July submissions from last year, good Lord willin' and the creek don't rise, and they got a ton of them to do. I've got a can I bought from Silencer Shop around that time as well, the form 3 was approved 9/3, the suppressor shipped to my dealer on 9/13 and arrived there at 9/19. The form 4 was submitted 7/7. |

You had two what approved 1/24? Form 3's? My Form 4s were submitted July 5th. My Form 3's were approved on 1/13. It appears there is no logic in how they work through their stacks of paperwork. |

Sorry, I didn't clarify - the two I had approved 1/24 were in state purchases and didn't require a form 3. |

Isn't the normal SOP to wait until the form 3 has been approved, then submit the form 4? New to this myself. Yes. Distributor to dealer transfers can't happen unless there is a form 3 filed and approved. After approval, the item is then sent to the dealer. The dealer then has the customer do a form 4. Doing a form 4 at the same time as the form 3 isn't the proper procedure. It's putting the cart before the horse. Too much can go wrong, such as the form 3 getting lost, rejected from an error, the distributor selling the same can to two dealers, etc. It would be the equivalent of you doing a 4473 for a gun your dealer doesn't have yet. |

I just got a May 1 stamp back a week ago. And a month before that I got some April stamps back. Quoted:

You've got to account for the glut of pre-deadline submissions also submitted around that time. In 6 months, I would imagine the wait times will start to drop off pretty well. |

I honestly don't know what to think. Looking at the Group Therapy thread, I could be seeing something in the next few weeks. Looking at the data on Silencer Shop's ATF wait times, it looks like the average is 314 days from purchase to stamp arrival for trust forms. So yeah, I guess I can go back to sleep until around mid April at the earliest as I'm currently at 246 days and counting. |

Sending out Form 4's before the Form 3's have cleared has been common for the 11 years I've been in the game. SS got the ok to do it from the ATF. You don't think they got thousands of Form 3's approved overnight before 41f do you? |

Snip... SS got the ok to do it from the ATF. This right here. A while back when they started efiling for other SOT's (the beta of their "Powered By" program), they said they had a variance to do so. As long as the form 3 gets approved before the form 4, it's all good. |
