Ok.  I decided I'm going to get a suppressor.  My dealer has a Gemtec M402 in stock, so I say I will take it.  Pay, sign paper work, mail it all out, etc.

Well over a month later, I call the ATF.  No go.  Turns out my dealer put the wrong S/N on the paper work.  I had called on a Friday, so I had to wait till the next week to talk to my dealer.

Well the then on  last Wednesday my dealer a copy of the corrected form then, but I don't get the message that I can pick up my suppressor till after they closed that day.  There were also closed Thur-Fri-and the weekend.

So I go today, and they call in my back ground check and now I get a conditional.  I gotta wait till next Monday.

I got a conditional last time I bought something from this dealer, and I had to wait a few days.  Can someone explain why the ATF is flagging me, and what I can do to prevent this annoyance in the future.  They are willing to OK my form 1's and this Form 4, but they want me to wait now.  Ugh.

I've heard others say someone with the same name has an outstanding warrant and they have to verify identification before approving.  Saw it happen to a guy locally twice @ the same shop, they even had a local police officer show up and check his id.

Umm...

Why did he do a background check?

If he would of read the 4473 he would of seen NFA transfers are exempt.

Unless Florida or your state has some state law, no NICS check or pistol purchase permit is required on a transfer involving only NFA items.

A NICS check is required if it is a trust, corp, LLC, etc. transfer.  A non-natural person entity purchasing the can must have NICS.

My dealer did'nt do a call in on my last form four and I'm in Florida. I did it thru a trust.

With a non-natural entity, NO background check has been done since the entity has no prints or background to check.  The natural person picking the item up on behalf of the entity does however.  This has been gone over in the Legal Side column in Small Arms Review in the late 90's I believe.  A question was posted and the attorney wrote BATF for a clarification.  A trust, corp, LLC, etc cannot show up and receive the item in person, so they require NICS on the person doing this on behalf of the entity.

I had a compliance check awhile back and the BATF inspector confirmed that this was the correct way to transfer an item so registered.

You want to get smoother NICS checks? Social security number.

If anyone has your name and is a felon a flag will come up.  If you use your social security number, they will reference you and not "your name" which can be shared by dozens of people

That might help.

There are a lot of classified clearance people around here (Wright-patt).  It has been a few years, but I remember awhile back and it seemed like they would always get delayed.

One dealer I have bought some stuff from usually meets me after hours.  It seems like when we are way outside of his posted hours, it gets delayed, but not when we are within them.

Just some food for thought based on my expierences....

SSN can cause problems also.One time when my sheriff ran a check on me my SSN came back with a couple of arrest for robbery.It turned out that some one made up a SSN when they were arrested and it was mine.SJR556.

I did use my SSN.


A  NICS check is NOT required then for an actual individual purchase. It says it right on the 4473.

I've bought 2 silencers using my trust this year and they never did a NICS check either time.

EDIT:  What is conditional?  I've never heard that term used in regards to NICS.  You are either PROCEED, DENIED or DELAYED.

Its another term for Delayed.  You wait a big, and generally then they let you pick up the item in question in 3 business days, but this time I get to wait a week.

What's funny is there's a black girl (young woman obviously) named like Keisha Jones that has bought like 8 guns through my local shop.  Each and every time she gets a delay and expects it but comes right back in 3 days to pick them up.

No NICS for suppressors. they already checked you out. You need it for MG,SBS,SBR and AOW. The trust thing is interesting I will need to do some reaserch on that one. When you form your trust isnt there a person listed as an executor or something...
