Ok. I decided I'm going to get a suppressor. My dealer has a Gemtec M402 in stock, so I say I will take it. Pay, sign paper work, mail it all out, etc. Well over a month later, I call the ATF. No go. Turns out my dealer put the wrong S/N on the paper work. I had called on a Friday, so I had to wait till the next week to talk to my dealer. Well the then on last Wednesday my dealer a copy of the corrected form then, but I don't get the message that I can pick up my suppressor till after they closed that day. There were also closed Thur-Fri-and the weekend. So I go today, and they call in my back ground check and now I get a conditional. I gotta wait till next Monday. I got a conditional last time I bought something from this dealer, and I had to wait a few days. Can someone explain why the ATF is flagging me, and what I can do to prevent this annoyance in the future. They are willing to OK my form 1's and this Form 4, but they want me to wait now. Ugh. -Postal, always disgruntled. |
Umm... Why did he do a background check? If he would of read the 4473 he would of seen NFA transfers are exempt. |
This is the first I've heard of that (I don't use trusts so I could have missed it), can you provide a little back ground on when that started and why? |
With a non-natural entity, NO background check has been done since the entity has no prints or background to check. The natural person picking the item up on behalf of the entity does however. This has been gone over in the Legal Side column in Small Arms Review in the late 90's I believe. A question was posted and the attorney wrote BATF for a clarification. A trust, corp, LLC, etc cannot show up and receive the item in person, so they require NICS on the person doing this on behalf of the entity. I had a compliance check awhile back and the BATF inspector confirmed that this was the correct way to transfer an item so registered. |

You want to get smoother NICS checks? Social security number. If anyone has your name and is a felon a flag will come up. If you use your social security number, they will reference you and not "your name" which can be shared by dozens of people That might help. |

There are a lot of classified clearance people around here (Wright-patt). It has been a few years, but I remember awhile back and it seemed like they would always get delayed. One dealer I have bought some stuff from usually meets me after hours. It seems like when we are way outside of his posted hours, it gets delayed, but not when we are within them. Just some food for thought based on my expierences.... Dan |

A NICS check is NOT required then for an actual individual purchase. It says it right on the 4473. |
Its another term for Delayed. You wait a big, and generally then they let you pick up the item in question in 3 business days, but this time I get to wait a week. |
