OK, speaking purely in hypotheticals, if the 1994 "crime bill" ban came back (which it can simply by changing 2 words in the law, never forget, it sunseted, that means it still exists), then the answer would be technicly no. No new "assault" weapon could be constructed after the effective date. People got around this by saying that a preban reciever may have been already configured before the ban. How would BATFE prove otherwise? A preban reciever meant that BATFE would have had a hard time proving you broke the law, you would technicly still have done so. To this date I would like to know how many people were actually tried under that garbage feel good BS law. |
This question keeps coming up. WHY???????? The 1994 AWB is over, dead and buried. Could a new ban with the exact same verbage be enacted, yes. But it hasn't, and until it does no one will know what the ban bans or doesn't ban. Lowers, complete lowers with retractable stocks can be had in these parts for under $250. Buy one now and stop worrying about the ACR, AUG, SCAR, or whatever other vaporware is hot on the net. Buy some cool shit now or take a chance on something uber cool that doesn't come to market and then leaves you SOL. But for the love of God, stop speculating on future bans that haven't happened. Um, no, the law isn't dead and buried at all, it is quite alive. The law stipulated that enforcement would end after a period of 10 years, the law still exists and can come right back by simply changing "10 years" to "indefinate". What does it take to do that? A simple majority vote of congress (some have argued that an executive order could as well, but I am not versed on that side of things well enough to be sure). By the by, hypotheticals are NOT REAL!!!!! No one said the ban was back or coming back, I explained to someone who asked a question. As for burden of proof on the .gov, you are correct, but do you know how many people I knew who had parts not even produced before the ban on their so called "pre-ban" rifles (mostly flash suppresors)?! Tough to win that case: "Yes your honor, I purchased several of these parts recently and then traveled back in time to assemble them on my rifle before the ban hit. Case dismissed right?" I'm not arguing this anymore, history is a bitch, we'll see her again. |

thanks for all the feedback and view points.... I'll be buying something soon (maybe a Bushy optics ready) just so I have something. I didn't plan on attempting to get an ACR when it come out anyway so I will likely wait until it's been out a while before I jump. |

There are enough dems to pass HR1022. With the way everything is right now it would make it through both the house and senate leaving the president to veto it. It hasn't had much activity becuase the dems know the president will veto. I believe they are waiting to see if they can get control of the house, senate and the presidency before trying to actually get it passed. This ban is a lot more extensive than the 94 ban ever was. The specific list is huge not to mention the vague explanation of what will be banned. From HR1022:
I read the "or" as having any one of those items and not needing all of them. Another thing that worries me is their defination of "pistol grip"
This could outlaw any automatic weapon because a grip is used to hold a gun, regardless of what it is. It also bans importation of any magazines over 10 rounds as well as banning parts for weapons on the ban list. Um, no. If this law still existed then it would not be legal for me and a whole lot of other folks to own EBR that were built since 2004. If the law isn't enforced then it is dead. Any new ban would have to pass both houses and receive the signature of the president. I'm personnaly going to keep buying as many guns and mags as I can until I'm not allowed to, which hopefully that will never happen. Did I mention we all need to VOTE! |
