When notifying your CLEO, do you add some type of cover letter explaining the forms?  Or just mail it in and let them figure it out?

It would be optional to do so, but perhaps not a bad idea.



Legally it is not needed, just send the form(s).

i did, saying that in "I'm complying with the recent regulation by the ATF,  41F, and that I'm notifying you and nothing else is required on your part".  I then included the forms.

It was a little more colorful than the above wording, but that was the jist.

I wouldn't add jack to it. They have instructions on the form. If they can't figure them out, hopefully they either trash them or send them back. Either way, you notified them and are done.

From the form:

Information for the Chief Law Enforcement Officer
This form provides notification of the applicant's intent to make and register a National Firearms Act (NFA) firearm. No action on your part is required. However, should you have information that may disqualify this person from making or possessing a firearm, please contact the NFA Branch at (304) 616-4500 or NFA @atf.gov. A "Yes" answer to items 11.a through 11.h or 13.a or 13.b could disqualify a person from acquiring or possessing a firearm. Also, ATF will not approve an application if the making or possession of the firearm is in violation of State or local law.

Take the forms to your CLEO and drop them off. Ask the front desk  to drop them off in his office, and call you when he has them finished.

So this all has me confused...



As of 41P, you no longer need LEO sign off to buy an NFA weapon, whether you are an individual or an entity, such as a trust? Now you just inform and they can object?




So did Obama actually make it EASIER to get NFA weapons? How many departments are going to spend the time to send an objection to the ATF? Does the CLEO have to specify a valid reason for the objection, such as 'this guy is a known trouble maker or has an arrest record', or can they just send an objection because they don't want people owning NFA weapons in their jurisdiction and essentially veto the purchase?

Correct.

It has to be a justified reason, not just an opinion or the fact they're anti-gun.

I read this on Silencer Shop's website:




"The photograph requirement will be addressed by a custom Silencer Shop App for iOS and Android that will take passport-sized images that will also be transmitted to Silencer Shop HQ. Per the BATFE rules, every two years the photographs will be need to be retaken. Customers will simply use the Silencer Shop App to grab another selfie."




So, if you have a silencer, then do you have to send the ATF new pictures of yourself every two years?




If so, then does this apply to people/trusts who had items approved prior to 41P? Say my stuff that I had, or had pending prior to 41P taking effect, do I now need to send the ATF pictures of myself every two years?

The statute itself says it has to be taken within the previous year.

You don't have to "go back" for anything. It would be future submissions.

Yep. Look at it this way...each submission is considered independently of the rest. Once submitted, that item is done. When you go to submit a new one, you'll need prints and photos. And that photo should be taken within the last year, per the regulations.

I know my CLEO has said that is wont keep the notifications.  I wouldn't be surprised if they are shredded within the hour.
