I have 2 questions about moving to another state. Yes the items are legal there.
1) What would I need to do with any items that already have stamps? 2) What about an item that is still pending? About 3 months to go. |

About 3 months to go. Depending on what the specific firearms are, you might need to file and wait for a 5320 to move them interstate to your new state of residence. AOWs and suppressors do not require this, but everything else does. Give yourself plenty of time in submitting the 5320s as you cannot move the affected guns without approval. Anything still pending when you move presents an issue because you are no longer a resident of that state. If the pending Form 4 is for you as an individual transferee, then as a resident of another state, the dealer who has the pending Form 4 cannot legally transfer the firearm to you upon approval. You would have to cancel the existing Form 4 and have the dealer Form 3 it to a dealer in your new state and restart the Form 4 process. However, if your Form 4 is through a trust, then any trustee in your old state can take possession of it upon approval. All depends on the details... |
