| Can someone please run me down the process for purchasing a SBS from an individual within the same state. This will be my first purchase of an existing NFA weapon. Is it just a form 4? Does he CLEO sign the form 4 also ? |

Private transaction within the same state is just a Form 4 from the seller to you. If you will be purchasing as an individual, as opposed to a business entity, then the CLEO, FP cards, etc... all have to be done. Thx for response . To clarify.... Me and the owner do a form 4. I then do a form 1 for the CLEO to sign in addition to prints. I send that form 1 off and wait . Who holds the weapon till I get the stamp? |

Prints and photos are sent in with the F4. Seller is legal to own the weapon, so they have to maintain control until F4 is approved. |
| If its already registered as a SBS by an individual/trust in your state you should be able to just transfer it via form 4 to you as an individual or trust without issues. Will need CLEO signature and finger print if its and individual, no need for those is youre a trust. Should be some stickied threads on around these forums outlining the process. |

Just to clarify your answer, only YOU do a single form 4 on behalf of you and the owner. The way you worded it makes it sound like you are suggesting you each do a form 4. |
| What kind of shotgun? If it were an 870 or similar I would attach a long barrel to it and take possession right away as a title one firearm. Then Fill out form 4 and wait. The seller can either hold on to the short barrel or you tuck it away until the form 4 is approved. Just me though. |

But isn't the receiver still in the registry as a SBS even though it is now compliant, therefore making the new owner still ineligible to take possession of the firearm as it is not registered to him? |

You can attach a full length barrel and sell the rifle/shotgun as a GCA item. Same thing with replacing the barrel for travel or hunting. It's only a SBS/SBR when configured that way, or if that's the only possible result with your combination of parts. The person could sell it as a regular shotgun and the buyer could file a Form 1. The Form 4 method mentioned above may also be legal, but I've never done it that way. |

It would be a whole lot cleaner to just buy a similar model, then Form 1 it yourself... The government just wants to get its $200 tax...

| All shotguns are a SBS with a short barrel attached, legal or not. All shotguns with a 18"+ barrel are a Title 1, GCA, legal shotgun, even those that have been NFA guns. The only advantage of buying one already converted would be the seller adding features that they can not get reimbursed for. (gunsmithing. Cerracote, threaded tube, sights etc) If they are too expensive, there is no reason to buy one. |
