I just had my trust notarized and scanned/e-mailed at the UPS Store.  I got home and opened the pdf file.  The notary seal is not visible in the scanned file.

Is this acceptable to the ATF or do I need to physically darken/color the raised image of the seal and have it re-scanned?  I haven't seen this mentioned yet.

Is it required by your state to have trusts notarized?

If so, then I would suggest doing exactly that -- shade it with a pencil so it's visible when scanned. That way, the BATFE knows the trust has been notarized and is legal in your state.

Thanks for the response.  I'll be shading it and having it re-scanned on Monday.

The trust doesn't have to be filed with state, bu does have to be notarized.

My notary had a cool little inker that just hit the raised parts of the seal.

That's why Texas went to stamped seal. With all the email and fax stuff, the embossed ones were a pain.

My class 3 dealer said he didn't think it mattered, but I think I'll be more comfortable having the seal visible to the ATF.  I would hate to wait that long just to wait some more.

Not all states require a notary to have and use a seal. In some states, just the signature is sufficient. That said, better safe than sorry. I would ink the embossed seal and re-scan it.

EDIT: Here's a chart listing which states require notaries to use a seal. Kentucky is not one of them.

Thanks for the link.  

I'm surprised that KY doesn't require it.  The few times I've need a notary they've all used a seal.

From what I understand if your eForm is rejected you start at the back of the line. No way I would chance that for an issue that can be fixed quickly.

I emailed Gary Schaible at ATF about an issue with my trust. You can fix it after submission so long as the form itself is correct. Still, no point in risking it or creating additional hassle by submitting a questionable copy.

If your trust has notary language in it, then you will have to have it notarized.  Even if your state doesn't require a trust to be notarized, the presence of notary language will require it.
