I logged into my bank account last night and was surprised that:
1. A $200 check for a Form 4 dated 7/16 was cashed 7/26; and 2. A $600 check for 3 4's dated 10/16 was cashed 10/24 That seems fast to me, but maybe I had never checked before. Hopefully that locks in my last few items into a grandfathered trust. If so, I might just turn in another form 4 or two.....IF I can find anything to buy.... |

I wonder how that would play out in court ( I know no body wants to be the test case ) but the tax would have been paid so they couldn't get you on tax evasion. If it could be proved that your check has been deposited in to the Feds General fund, a case could be made on the 5th amendment that the .gov has deprived you of your property ( monetary / said nfa item ) by cashing your check and not giving you a receipt for x amount of time thus depriving you of your physical property you have paid for and the tax money you have paid. Basically they have deprived you of both product and 200 dollars. |

Refer to ATF 5320.XX instructions section 3: "Approval of Application" "Upon approval of application, ATF will affix the appropriate NFA transfer tax stamp, cancel it, and return the approved copy with the stamp affixed to the transferor for delivery with the firearm to the transferee. Since the approval of the application effectuates registration of the firearm to the transferee, the physical transfer of the firearm must be completed immediately; however, the transferor must not transfer the firearm until the application has been approved and received..." Basically, transferring the item before the form is approved will never be kosher because of when the registration is adjusted and the item becomes the transferee's responsibility. Physically transferring the item prior to approval would also open the door for items to potentially make it into areas where they are prohibited by law and possibly into the hands of people who are prohibited from owning them due to any of the reasons stated in Instructions Section 7 sub section b. I only have a minor in law so I may be way off on this but that is my interpretation...I wouldn't take it to court
