I have an AR pistol with a 7.5" barrel. Is there an minimum length requirement for making it an SBR?
Thanks, zw |

Depends on the state laws and original configuration of the firearm. you also need to know the technical definition of the terms rifle, shotgun, sbr, sbs, aow.
here it is short and sweet, i am not a lawyer or interpret law, your mileage may vary, check you local laws. etc. -a rifle has to have a barrel 16" or greater AND oal greater than 26". -a shotgun has the have a barrel 18" or greater AND oal greater than 26" -both rifles and shotguns are firearms that are designed to be "fired from the shoulder" -an sbr and sbs are defined as a rifle or shotgun that has been made or converted to a firearms that is designed to fired from the shoulder and dont meet the minimum barrel and/or oal requirements. -an aow is a firearms that doesnt fit into the other categories, ie. a pistol with a vertical foregrip or <26", etc. here is an example with a mossberg pursuader and how it can be converted to less than 18" but not fall under the NFA regualtions as a sbs or aow. lets say you start with a mossberg persuader 12 gauge "shotgun" that has a 20" barrel. This firearm is Pistol Grip ONLY from the manufacturer. On the 4473 it is NOT transferred as a longgun, but rather as an other, since it was not designed to be shoulder fired. If you put a stock on it, it then does become a "shotgun" since it was remade to be shoulder fired. if it is left in the pistol grip only configuration, the barrel can be shortened to the point that the oal is just greater than 26". with a birdshead grip it can be shortened to a 14" barrel but still make the oal since it would be 26.25" long. if the length is taken to less than 26" it would become an AOW and would be regulated. so to answer the question, on an ar-15, the barrel can be shorter than 16" as long as the receiver has never had a stock attached. the oal doesnt really apply to this since you would be making a pistol, like the OP has. Where the oal comes into play would be if you wanted to add a vertical for grip to the pistol. People have interpreted this as if the pistol is >26" oal a vertical foregrip could be added without making it an AOW. I dont necessarily agree with that, but a few people do see it that way. again YMMV. IF the barrel is less than 16" and you have a stock on it, it is an SBR since it is remade to be shoulder fired. |

its funny, i think of myself as someone who knows a fair amount of nfa stuff (im an ffl though not class 3) and its always funny when i dont read something right. you are absolutely right. i was wondering because one i read it as AND (cuz i didnt pay attention) and two, i had just found out recently about the non NFA shotguns with the 14" barrel. so i thought maybe i missed something.
at first i was like WHAT i just send in a from one for my mp5 i built and with a stock it would probably be just over 26".
