Does the notary that stamps your NFA Trust have to be in the state where the trust is set up?

For me I live in WI but work in IL. I don't get any time during the work week to find a notary in WI let alone get there during business hours. We do have one at work but obviously she is in IL.

Any thoughts?

A notary public is only a witness. I would ASSUME it wouldn't be a problem since all they doing is certifying that they saw the stated person signed it. Usually Notary Public suppose to check your ID and such to make sure you are who you say you are. Thats how I see it. My Trust is from County A and I got a notary public person from county B to notarized mine. I know mine is different county, same state but wouldn't that be the same thing as different state? lol.

I am a Florida Notary.  Notary law is state specific and Trust law is state specific.  In Florida I can notarize anything you put in front of me (well, not anything) BUT, I can not give legal advise and thus I could not tell you that you were probably not executing your out-of-state Trust properly.  In fact I would not even know what the Trust laws are in your state.

The problem here is not Notary law, but Trust law.

I have notarized out-of-state documents, but only at the direction of the client's out-of-state council who was aware of the situation and concurred with the legality of process.  In other word, what did your attorney say when you asked him?

I don't recommend that you do this. ATF legal reviews every trust and I would not do anything to cause them to question the validity of your Trust.

Normally Notary issues arise when someone questions the validity of the signature after death, so in the case of an NFA Trust would probably never be an issue, but...this is ATF right?

From the Florida Notary handbook:

Documents Prepared or Notarized in Other States
When notarizing a signature on a document that was prepared in another state, make sure that you
add the required information to make your notarial certificate comply with Florida law. This means that
you may have to change the venue (State of Florida, County of _____________), add the type of identification,

There are notaries that offer their services and will meet you at a neutral location.
I don't know where you live in Wisconsin, but here is a quick search from the Milwaukee area. http://milwaukee.craigslist.org/search/bbb?query=notary&srchType=A

I just searched for notary under the services listings.

ETA: Also, around here there are some banks that are open for a couple of hours on Saturday morning. If it is the same in your area, they should have someone that can notarize it for you.

My bank notarizes for free. This is probably your best bet.
