I need a copy of Schedule of Compensation for Trustee. I bought an AAC silencer in 2009 with a Trust with no trouble. I went to get another one and use same Trust but Bulls Eye noticed the "Schedule" was missing. Jeremy at Bulls Eye said they would reject my stamp and I needed to get a copy. If anyone has a copy this would help me out a bunch.

OP - if it's only listed in your original trust once, cross or white out through that section and send it on. Revocable trusts can be amended by the grantor until the day they die. |

Completely different situation. You can buy contracts as stores like Staples and Office Max but they aren't practicing law w/o a license. It's highly unlikely an FFL is just handing a person off the street a trust and telling them to fill it out without providing them information about how to do so. That "coaching" is practicing w/o a license. |

So a program can assist a person to make a Trust, but someone who has public access to Trust documents, can't? Quicken Willmaker and other legal software is just a series of blank templates. Same as if you had purchased blank forms from an office supply store. You buy it, you fill it out. No problem. When someone else fills it in for you, however, that act could be considered as constituting the practice of law. You need to be licensed to fill in those blanks for a third party, or to advise someone how to fill them in. That is what lawyers do. Offering to do so for your customers makes it an integral part of the sale, and thus, the FFL is being paid to practice law. So if an FFL who is not a lawyer hands you a stack of blank forms, that is legal. And if an FFL who is not a lawyer hands sits you down at a computer and tells you to click on the Quicken icon, then walks away, that is legal, too. But if they touch the keyboard, or tell you anything about how to fill it out, they may be prosecuted for practicing law without a license, which is a felony. And that could cost them their FFL, so IMHO it is very unwise for an FFL to do so. |

Jeremy, I am guessing that you have one of Doug's trusts (or copied someone that does) based on your location. What others have done to resolve this is create a separate page with formatting just like the rest of your trust with the information below. I am not a lawyer, just stating what others have done. One would replace "Section 9" below with whatever is appropriate but I will go out on a limb and guess that yours is also Section 9.
STATE OF GEORGIA COUNTY OF <COUNTY NAME> <Name of Revocable Living Trust> Schedule of Compensation for Trustees The trustees agree to forgo compensation at this time and until any further amendment is agreed upon in accordance with Section 9 of the Declaration of Trust. |
