From another thread I understand that you still fill out a 4473 but they don't contact NICS to run a background on class 3 items. So I'm wondering how do they keep from transferring from restricted persons when the item is being registered to a trust or corporation? With either of those there are no fingerprints, pictures, cleo check, or even a name (depending on how you do your trust/corp).
Can someone explain to me how that works? |

Can someone explain to me how that works? Its just how it works, the way you put it. The system of corporate transfers can be abused by felons. They would still be guilty of the same felony if they had the NFA item if they are not eligible otherwise to own/purchase/have that firearm. |

They disallowed a trust and the transfers to that trust that they found out had a felon as a member of it. Its not a perfect system, but its how it works for now. |

My SOT does the phone call to FDLE even for TitleII stuff. He claims he was told he had to during a compliance inspection. I just go along with the program, but the extra 5 dollars irritates me since I have already paid him 100 dollars to do the transfer.

He charges you an extra $5 on top of the $100 "transfer" fee?
I know my local shop was told to make the call at the compliance check. Well, that and the state police said to as well. Got to keep them happy. |

FYI, the language of the 4473 says that it's only exempt for NFA sales. If there's anything non-NFA involved (a Title I host gun with an integral suppressor, the same but with a sear or conversion part, etc.), we have to call in.

It reminds me of dealers that charge a $25-100 fee to fill out the F4 when buying in store. Just be sure that there aren't any state laws that demand a call be made. Here in WI, a handgun is defined as a rifled or smooth bore. Thus, we have to call the state (WI uses its own background check system for handguns) for an AOW "shotgun" transfer because it's a "smooth bore HANDGUN." That's an additional $13.00 and an additional 48 hour waiting period. Stupid? Yes, and I'd love to see that done away with completely. But until it (and the jail time for me) goes away, it's the law. In Connecticut <12" SBRs (SBS< MG, AOW, etc... are considered pistols for state purposes and would still require the state mandated BG check when transferred in a private sale. (Everything sold by a dealer or at a gunshow requires a check). |
