Ok, I have done a Trust.

For someone who has went this route can you let me know if this is correct?

What Form do I use? Still Form 1 right?
What do I send to the ATF with my packet?
copy of the Trust?
or the ceritification of living trust notorized?
At the header my Trust reads:

MOLON LABE
LIVING TRUST
DATE

would MOLAN LABE be the name of my trust or is it my name as the Grantor?

Just trying to cover all my bases before I mail this off.

are you making an nfa item or is it just a transfer?

forms to submit with packet:

two "wet" forms of whatever it is your sending (wet meaning not a copy, but an original signature)
two copies of trust with all attachments (schedules)
1 cert of citizenship (some say you don't have to, just go ahead and do it)

the title of your trust is "molon labe living trust"?

if that's the title, then that's what you put in the box.

One copy of the trust worked for me. They want two copies of the application so they can send one back to you.

To the OP:

You will need:

-2 Original Form 1 or 4s, completed correctly
-Copy of full Declaration of Trust, including schedule A
-Citizenship Certification
-$200 check made out to BATF

I will be building a SBR. I will get the lower to start with. Just waiting until I get this packet straight.

Ok so two original copies of the Form 1. Got it.
Declaration of Trust? Is this the outline of the Trust with all the information as to what is what and what goes to who? I still have to get it noterized but what do I do with it after that and how do I get the right paperwork to go with it for the ATF? This is the part which I am confused or hung up at. Not sure what to do with it once Ive writen it up as I have.
And what and how do I get the Schedule A?
Certification of Citizenship will go with just in case.

Not an OH attorney, but in some states you may or may not need to file your trust.... in my state you don't have to file a simple (not real estate) trust.

A schedule "a" is something that lists what property is in the trust.  can be anything.  if you don't have a schedule 'a', (no property in the trust), in my state you don't have a trust.  you can't have an 'empty' trust.  has to have something in it.  so, put in your schedule 'a' something that you want to give to the trust.  then you need to have an assignment of that property to the trust.

Ok, got it. I now have a Schedule A in my Trust. When applying for the SBR that I will have the lower in my possetion when I submit to the ATF, does it need to be listed in the Schedule and that will all that I want in the Schedule A. Also When doing one for the Suppressor, I know that one will have to be on the application as well but is that done in the same manner and is the Suppressor done on a F4 instead of a F1 like the SBR? This hopefully will be the last question. I just want to get this right the first time as does everyone being as it takes so long. Thanks

for a suppressor, you will pay for the item first, and your FFL/SOT should fill out the Form 4 for you with their information and the information of the item, it goes on the schedule A after you take possession.

for an SBR, i've always put the Title 1 firearms into my assignment of property, the only way i could see this being an issue is if you labeled the trust like "NFA trust" or put a title on the schedule a like "list of NFA firearms" as it's not an NFA item until you get the approved form 1 and actually make it... does that make sense?

for suppressors/nfa items that are pending, i actually put on my sched "a" the item, serial number and then (PENDING TRANSFER) in parenthesis

Is the 5330.20 only required for the applicant named in the Form 1? My trust has myself and fiance as grantors. Thanks
