A friends father recently passed and he is in the process of completing his Form 5 for a '68 registered bring-back. (not going to discuss the actual weapon at this point)

When the weapon was initially registered, it was done so as unserviceable and the method listed was "filing down of the firing pin". (Not a current ATF approved method of rendering a weapon unserviceable)

So....can he F5 the weapon as serviceable? The parts are readily available and an easy swap.

If he can not, is there a procedure for returning the weapons status to serviceable?

He's looking at the difference between a $600 curio and a $20K+ MG.

Thanks

Is this something with a fixed firing pin? I can't imagine that "filing down the firing pin" would have ever been an acceptable method if it weren't.

Does that mean you will replace the bolt?

Just curious.

It is a fixed firing pin. However, all parts are readily available, including FA bolts.

I would think that in 68, parts were not nearly as common or even available.

If the papers say it is disabled he has to Form 5 it, and then follow the normal Form 1 process (except checking the 'reactivation' box) to reactivate it, including engraving his name, city and state.

Question: If it was "registered" as a MG, does serviceable/unserviceable really matter?

Yes, because DEWATs (Deactivated War Trophy) transfer tax-free but may still be returned to functional condition after 1986 by Form 1.

Didn't DEWATs used to need a hardened, tapered pin welded into the chamber, or some such?

Yes, your friend should do the Form 5, then do the Form 1 to reactivate it.  Some folks advocate transferring it on a Form 4 (tax paid) and then just treating it as a regular live gun, but Bob Naess (who has forgotten more about the NFA world than I will ever know) strongly advises against this in case of future questions about the gun's legal status.

Bob can be reached through Black River Militaria (www.blackrivermilitaria.com) and will be happy to help preserve a piece of our history.

Good find!!!

YES it does matter.  serviceable MG's transfer tax paid vs unserviceable MG (DEWAT) transferring tax free (which may be re-activated on a F1)

your friend needs to F5 the gun to himself as a lawful heir and then file a F1 to reactivate it to live MG status.  He will have to engrave his info onto the gun but it will be worth much more as a live gun than as a DEWAT.

Maybe a dumb question but could an 07 SOT re activate it ? after the F5 goes through
