Lets just say I know this guy, and his grandfather who has passed away gave him a gun. Well this gun has been in storage for years and the person is not even sure what it is, possibly a full auto weapon. Is there a possibility if in fact it is full auto for this person to legaly register and keep this gun? Thanks in advance.

Nope.  "This guy" has two (really, three) options if it is indeed full auto and not already registered:

1.  Destroy the weapon.  Cutting torch, steamroller, etc. and dump the parts in the ocean.
2.  Turn weapon into Police/ATF.  Could be tricky to do so because of potential for prosecution of unregistered MG
3.  Blast away.  Get charged, convicted, and spend 10 years and $250k getting to know Bubba at the greybar motel.

I believe if it was legally registered then he should be able to keep it. But if it was never registered then it will be illegal. Machine guns can't be registered anymore. I say it's really his call if he wants to call up the ATF and find out if it is legal or not. Of course first i would find out what the weapon is since you don't seem very sure.

Now that you know the repercussions...do what grandpa did...YMMV...[/thread]

EDT: Have him look for BRING BACK PAPERWORK AS WELL!!! This was SO LONG AGO that in fact it MIGHT have been registered but ATF "LOST" the record...the paperwork will be the burden of proof...

Have a lawyer check the number with the NFA and see if it is registered. You may get lucky?

B - If it is indeed a machine gun or DEWAT, go entirely through everthing in grandads house, find the registration papers, if you cannot find, proceed the "C"...

C - Call the ATF NFA and inqiure about registration validity of serial number.. is it registered and transferable or not..... do it from a pay phone along the interstate somewhere.

D - Transferable, estate person can tranfer out to family heir on a form-5 (free),  or other person on a form-4 ($200)

E - Not registered, quiety take apart for a parts kit, destroy the receiver, sell the parts kit for $$,,, or look for a museum to accept the gun, National Air Force Museum here in Dayton  at Wright Patterson AFB be a good choice if they will accept it..

I thought the ATF would not respond to registration inquiries via phone and required you send it in writing, thus the preference for using a lawyer?

YES, if it was lawfully registered, this person could legaly register and keep this gun on form 5. Suggest he consult a NFA-aware attorney.
