My wife just recently moved to Minnesota (which is an SBR-friendly state) but I am still in Michigan (which is NOT SBR-friendly) until I can find employment over there. My question is can I form a trust for my wife and I and submit my Form 1s to SBR a couple of ARs and maybe my FAL while I am still in Michigan? The trust would be based out of our address in Minnesota, notarized there, and mailed from there.

From the ATF Firearm's FAQ:
(B12) May a person (who is not an alien) who resides in one State and owns property in another State purchase a handgun in either State? If a person maintains a home in 2 States and resides in both States for certain periods of the year, he or she may, during the period of time the person actually resides in a particular State, purchase a handgun in that State. However, simply owning property in another State does not qualify the person to purchase a handgun in that State. Also read question (B11) regarding residency. While this question was addressed to handguns, it applies to all firearms - including NFA. I live in multiple states during during the year, and have used both addressed to buy / build NFA firearms. You just need to make sure you "reside" in the state where you are registering the gun when you actually make or buy it. With a trust, so long as it is set up in MN, you should be good. Just make sure you have both your wife and yourself listed as trustees so you can both have access to the gun. And of course you know you can't take your fancy new SBR back to MI with you. I lived in MI for a year and had to store my SBRs and silencers out of state while I was there. |
