Getting my first Class III item and have a question: Because of the paperwork required to get the stamp, does the BATFE also require a NICS check and 4473 filled out upon transfer, or is the stamp enough?

4473 yes, NICS no.

I think they go beyond a NICs check while examining your NFA application. Especially when they want fingerprint cards and a photograph.

If you go the trust route, though, there are no fingerprints/photo.

This.

The 4473 is the Dealer Record Of Sale and will be filled out for everything he sells to a non-FFL.  No NICS check.

Does this apply to suppressors?

Yes. 4473, the object is marked as "other" and you are on your merry way without any NICS check.

Interesting that the NFA item could be bought by a trust,  and it could be released to anyone who can wal into the store and say it is theirs :-)  Let's not give them any more ideas, eh

On NFA items that are in a company's name you have to do a 4473 and NICS check.

Individual ownership still have to do a 4473 but no NICS check.

What about trusts with a sole trustee?

No NICS check on NFA items corp or otherwise (see box 22 on yellow form & clarification instructions from recent Newsletter).

However, Corps and other business entities must provide the written statement of use, as outlined in Instructions for Question 1.

This was not the case for my Corp's acquisition of a suppressor.  4473, no NICS.

Had a visit from the BATF (unannounced regular inspection) and they said they want to see 4473 and NICS for whoever is taking possession of the item.
I guess doing a little more is better than doing not enough...

I had to do a 4473 and an NCIS check for my can by one of the dealers here on the forum.

He gave me hell cause I dont have my GFL that would have avoided him doing the NCIS check.
