I have recently seen difference of opions if I should include the the machinegun I am transfering to my tust in the copy of the Schedule A I send to the ATF with my form 4s? If I add them to the schedule A when I send them in should I also include the assignment of prperty but left blank? I do not see how I can add it to my trust before ATF approval.
For my last few transferes I only sent in a copy of Declaration with the form 4s and they got approved. Now I have been reading here the ATF now needs a copy of the Schedule A. Thanks for any help! |

Why would you put something on the Sched A that you dont have in your posession ? Schedule A is about OWNERSHIP and not POSESSION. If you paid for the MG, you own it... Examiners have approved with the items listed, and with them not listed. So paying for something and it sitting at your dealers house is considdered ownership? I dont considder my can MINE until the paperwork clears then its MINE. At that point I own it. |

My examiner said to only list items that you have approved forms for. You have to send the complete "declaration of trust" documents now to check for legalities in your state. Schedule A should only have things your legally own. Thank you! Thats what I thought as well I do not legally own the item yet so I cant put them in my Schedule A. |

You can transfer it to yourself, have the dealer sit on it, or broker a sale, etc. ATF has repeatedly stated that a form 4 is not a 'title' or proof of ownership. It's only a proof of registration. YMMV |
