| Let's say, hypothetically, that I am a C2. I have an MP5 on a form 3 and I wish to destroy the receiver and sell the remainder of the weapon as a parts kit. Of course, I want my paperwork to reflect this. How would one do this? |

Either look up existing guidance on approved destruction guildelines for MP5 receivers, or write to the ATF tech branch requesting such guidance. They'll tell you exactly what you need to do to an MP5 receiver to "demil" it.
Perform the demilling, then notify ATF that the machinegun, serial number xx-xxxxx has been destroyed, and ask them to remove it from the NFA registry. Sell the parts kit. Maybe keep a photo of the destroyed receiver showing serial number for your records. |

The big no-no is if you have a pattern of behavior of doing this, one or two isnt prohibited but if you buy 50 MP5s and 50 SW recievers and end up with 50 SBRs and 50 demilled HK recievers you'll have some 'splainin to do.
Keep the chunk of the demilled reciever that shows the serial number if you choose to demil it yourself, following the ATF procedure to the letter for that particular model. Or, you can strip all the parts off and surrender the bare reciever to the nearest ATF office, let them figure out what to do with it. Kharn |

A C2 (as the poster hypothesized) just has a lot of paperwork 'filin to do. A hypothetical C3 would indeed have some 'splainin to do, though, and a non-SOT shouldn't be in possession of the postie in the first place. |

Cut the reciever in the prescribed manner per ATF guidelines. You can find this info out by calling ATF Tech Branch as each NFA item has a different destruction procedure. Keep the SN# section of the reciever as proof of destruction and send a HAND WRITTEN letter of destruction with SN#, Model and destruction method (per ATF guidelines) to James Robinson in West Virgina. He will send you a signed letter back saying that the ATF Registry has been updated. Keep the letter with the cut section and log it out of you Bound Book as destroyed with the date. Sell the parts to cover your loss of the Post '86. I have been doing it this way for ten years and ATF says I'm completely covered and the letter protects me. FWIW. ..............................
