Yes, you put SBR under the type of firearm to be made. Under the lengths you put the new ones, not the current ones. In other words, if you're putting an 11.5" barrel on your new SBR, put 11.5" under barrel length. |
When you receive the approved Form 1, you have permission to make an SBR. But under NFA law, it is not "made" until the instant you first assemble it in NFA configuration. At that moment, it becomes an NFA item. Up until that moment, you can still change your mind, notify BATFE and get a refund of the $200. But the minute the upper touches the lower constitutes the act of "making" and you can no longer get a refund. BATFE wants you to specify, on the Form 1, the exact configuration of your SBR at the moment of making. Once it has been "made," it is legally an SBR, and you can legally use any length upper on it thereafter. The Form 1 spex are the initial configuration, but nowhere does NFA law limit you to any single configuration once an SBR has been registered. BATFE does ask that if you permanently change the primary (initial) configuration you notify them by letter, so they can update the NFA Registry and maintain its accuracy (which is one of their charter responsibities). But OTOH, there is nothing in the law requiring you to comply with that request. |
