A friend has an ill relative with a DWAT MG. I dont know the whole story, but he says it was a bring back and has the paper work. How could this be transfered, and can it legally be restored to full auto? |
|
It will transfer using a tax-free form 5. Once the transfer is approved you can take possession of it. Then, to re-activate it, you have the option of doing it yourself using a form 1 or having a Class 2 FFL/SOT do it for you. In this case, they register it on a form 2 and transfer it back to you using a tax-paid form 4. |
Yup. Because they are not live machine guns, there is no transfer tax (unless or until you decide to reactivate them; then, you pay the $200 tax when you file the Form 1, or alternatively you take possession from the C2 who is converting it for you, via the $200-tax Form 4). |
The same places you get Form 1s, Form 4s, etc. Either order them by mail from BATFE, or download them here: titleii.com/Forms.htm |
I dont know, just that it was US, WWII, steel with a wire stock. I'm guessing an M3. |
Have them cancel the transfer. No big deal and completely legal, even if the transfer has been approved, as long as the item itself hasn't changed hands yet. Joe |
That's what Id do. If said story is true. Grandma just lost a whole lot of money. |
its not my place to do anything. I was only contacted because a friend of a friend who knows the guys wife knows I sell machine guns.... I dont even have a phone number, they called from a phone blocked by caller ID. |
