If you're planning on working out of your home then check your zoning regs to make sure that you're permitted to run a business out of it. Many residential areas don't permit it, and while your neighbors will turn a blind eye to the lady on the corner selling Mary Kay, when it comes to guns it's a whole 'nother story. If you already have commercial space available then there's no need to use one of the "packages". Contact ATF directly for the proper forms. |

If you own a store and want to sell guns, or are planning on opening a store to sell guns simply call the ATF and ask them to send you the FFL dealers application package. If your not planning on selling guns as a legitimate business it is doubtful you will get a license and if you do, they will likely revoke it after your first annual inspection. While it is technically possible and still done in some very rare circumstances, getting a "Home FFL" to sell guns in your living room has all but been done away with. You will have to get a state sales tax number, county and or city business license, letters of approval from your zoning commission and if your renting the property where your planning on putting your store a letter from your property owner stating they know your planning to open a gun store in the property and they are OK with that. If you own (or are buying) the property, your going to have to have proof of that as well. Depending on the ATF inspector that is assigned for the site visit you may have to have a letter of approval from your mortgage company as well. You will also probably have to have a visit from the Fire Marshal. I think that covers it but I may have forgotten someting. If you have an other questions, feel free to ask. |
| If you wan to open a gun shop and you rent commercial space to do so that is zoned for business do you have to get the owner to ok it? Also, is there any restriction on how close to a school you can open a gun shop if you are renting commercial space zoned for business. I have heard you can't open a shop within 1000 ft of a school or something, is that good info or bad? |
No. basically you can get a C&R FFL if you are legal to own guns. Very few hoops to jump through. While you do have to mail a copy of your application to your CLEO, he can just chuck it in the trash and you are still good to go. He doesn't have to sign anything. It just gives him the opportunity to object if he wishes. He doesn't even have to acknowledge receiving it. You just sign the statement that you sent it. |
No. C&R Stands for "Curios and Relics" I'm not really up to speed on exactly what fits that description but more or less it is old stuff, in most cases, very old stuff. Forget anything like a Glock, 1911, AR, AK and so forth. I'm quite sure somebody will come along shortly and give you a complete description of exactly what old and antique guns fit in the C&R category. It is also a COLLECTORS license, NOT a dealers license. The purpose of it is supposed to be to allow you to enhance your collection (of old and antique stuff), not to let you become a gun dealer.
