I have a few ARs and I've decided I want to take the plunge and make one an SBR.  I know the process to file, but my question is this:

Suppose the following:

You're an ATF agent and you execute a search warrant on my home.  Inside you find the following:

- Five AR15s, each with an attached non-NFA upper (16" barrel or longer)
- One of these five is registered as a SBR
- Two short-barrel uppers (a 14.5" and a 10.5")

You then interview me and I state that "I only attach those short barrel uppers to my registered SBR AR15".

I recall reading that even having the materials in possession to create an unregistered NFA weapon is a federal crime.  Can I face any kind of prosecution because I have more short-barrel uppers than I do registered receivers?

I'm not sure, but isn't that like haveing a AR15 pistol upper?  If you have the pistol and other non ATF ar's you could just put the pisol barrel on one of the other ar's, which i know is illegal but it's kinda the same thing right?

IMHO:

You could be prosecuted, but since you've already gone through the paperwork to register an SBR, it would be hard to prove you intended on having an illegal SBR.
