Here's my situation. I'm active duty military stationed in Hawaii and I have a C&R FFL. Hawaii doesn't allow machine guns, however, my home state of South Carolina does. I keep my state of residency back in South Carolina. I've had my eye on getting a Reising M50 for a while, but I have a question since it is a C&R eligible gun. If I were to buy the gun in my home state of South Carolina i'd have to store it with my parents (in a gun safe that I only have the key to). Here's my quandry. I'm supposed to log in all C&R firearms I buy while my license is in effect. So, would it stir up problems for me if I have this type of machine gun, which is not legal in Hawaii, logged in my book, but not on the premises? I'm sure if I were to get audited, then there would be all kinds of questions. I've got half a mind to sent the ATF a letter for their official guidance on this. Any help or insight into this is greatly appreciated. |

I'm military too. You have to be the only one with access to the weapon. So, it would have to be stored in a safe or something with oyu being the only one with access to it. As for the C&R. Good question. You may own the NFA device, but it is not owned at your licensed location. So i don't tihnk you'd need to have it on your books. Definite tag for more info. Also, another thing to concider. ATF doesn't give a shit where you think your home is. If you are stationed in HI, your state of residence is HI in the eyes of the ATF. |
| IIRC when i got my C&R FFL i read(in the FAQ's) that the only thing that needed to be at the address on the FFL was the A&D records bound book. you can store your firearms elseware(which would make sense for an NFA item). if they audit you it is your choice to have them come to the address listed, or you could opt to bring your records book and firearms to the nearest ATF office for inspection. so, if your FFL is in SC then you are good to go as long as it is entered into your book and stored per guidlines. if your FFL is in Hawaii and they don't allow MGs then the ATF won't OK the form 4 as a C&R transfer. the hard part would be in getting the LEO signoff in SC while in Hawaii. the other option is that if you can do the transaction without your C&R in SC through a C3 dealer(need proof of residency ie...Drivers license and LEO sign off). you would still need to enter it into your bound book, because you own it and any C&R acquired while you have a C&R FFL needs to be entered no matter how you acquire it. |
| i can empathize with you, because i was a MN resident working(living) in CA. while in CA my C&R address was in CA, but my DL, taxes, insurance, vehicles, property, etc.., etc.. were in MN. i would my stuff while in MN, and then have to turn around and enter them in my bound book when i got back to CA. it was a pain keeping everthing straight and entered/up -to-date. now i am back in MN permanently, along with my C&R FFL and all firearms (no more hassles). i to am looking at buying an M50 reising(prob this fall/winter when i get the money together). it'll be a great day when i get a MG in the mail direct to my door. |
