MSM has been using the Major League sports themed patches relating to AR's and the military theme for quite some time with the "Major League Sniper", "Major League Infidel", and "Major League Doorkicker" patches. So the OP should not really be given any shit for using that design.
You should make a patch that says "MLDS" and see if they get it...Major League Design Stealing

If your patch is indeed your original creation, then it is protected in the USA by copyright law.
Contact a lawyer and pay a small fee for him to send a cease and desist letter. Or you can google "cease and desist" and cobble your own. Send it registered mail. Also register your artwork with the U.S. Copyright office. This makes you eligible to receive statutory damages. Good Luck. I am not a lawyer, and this does not constitute legal advise. He may have done the zombie skull artwork, but the instantly recognizable colors, and appearance are definitely not his. Not to mention the "Major League" reference. |

I know a guy who got threatened with a lawsuit over something similar. I seriously doubt it. It's been done plenty of times by a bunch of other vendors of all kinds of goods.....if those people havent gotten letters I doubt the op will. Not only that but it's perfectly legal to do parodies of companies logos. It happens ALL the time. |

They will probably come up in a search for a long time. They will be on Archive.org's Wayback Machine forever!! You can actually look at Archive.org and see the exact day he posted those to his website if you decide to press charges. Then you can ask for all his sales records from that date on to get your money that's due to you.
Edit: Looks like he was sneaky and prevented his website from being crawled. However the first time his site was up and running was May 12, 2010. Quoted:
