Well to make a short story long....

I acquired a new SW40VE back in '01 for $300 & within a month I had completely locked up the pistol trying to take it apart to compare it to my Glocks.
Well I dragged my feet shipping it back but in late '02 I got it back from S&W after a 2 week turn around as NIB.
They even sent me a pre-paid shipping label.
No questions & no cost.

So I finally get to the range with a couple boxes of TMJ (flat point ball) & have almost constant failures to feed with the 10rd mags.
So I break out the 15rd pre-ban mags I'd acquired & it empties mag after mag without a hiccup. Hmmmmm....

I go home & inspect the mags & it looks like the mag-catch notch on the 10rd's is oversized & a little higher up the mag body than on the 15rd mags. Also the 15rd mag have a noticeably longer mag body, even though the OAL is close the different size base pad covers most of the difference.

So the other day I go back to the range with trum FMJ & various HP ammo.  Again the 15rd mags work flawlessly but the 10rd mags will only feed the FMJ & 1 brand of HP ammo(UMC 180gr).

With the 15rd mags this seems like an OK pistol other than the slightly heavy trigger pull which can be alleviated with a Wolff spring.

Should I call S&W and ask them to swap out the 10rd mags or just forget about it & keep blasting away with the 15rd'rs ???

Forget about the 10 rounders. I've got an older 9mm Sigma (SW9F) with a lasermax that loves my 17 rounders, but also can't stomach 10 rounders. I took both 10 rounders to the gunshow last weekend and sold them for almost enough money to buy a third 17 rounder. I pitched in the extra 15 bucks.

I picked up a SW40VE back a few months ago and it has never failed yet.  But, I have never used the 10 round mags that came with it.  I'm issued an older SW40F and have plenty of restricted 15 rounders for it, so that's what I use when I go shooting.  Next time out, I'll take the 10 rounders and see what happens.  I'll post the results when I do.

I am planning to buy a SW9G next, so I picked up a pre-ban 9mm hi-cap on another board a few weeks ago.  The price was not bad on that, but the .40 pre-bans are going right up there.  Around here, the dealers get about $80-85 each for used mags.

I live about 30 minutes away from the S&W factory and have brought back a couple of handguns for warranty work and have always been very pleased with the results.  I would not hesitate to send back the 10 rounders, I know they will replace them.

I finally took my 10 rounders to the range today.  No feeding problems at all.  I would send yours back to Smith if you haven't already.
