I thought I would put this out there as a seperate thread: ... Someone was trying to sell a MAK90 on another board, and someone mentioned that up to 6 parts would need to be re-placed to stay legal. (922R ?) Does this apply just to Chinese weapons, or any imported AK47? - w |
Not to "stay legal", as the gun is already in a legal configuration. But if you want to change from a thumbhole stock to a standard pistol grip setup, then you have to swap out at least 5 foreign parts with US-made equivalents. This makes the rifle "US made" in the eyes of the law, and allows it to be rebuilt into a non-importable configuration. Typical US parts used in such conversions are hammer/trigger/sear (3 parts), forearm, buttstock, pistol grip, gas piston and muzzle device. US-made magazine parts (floorplate & follower) are also available for 7.62x39 rifles. 922(r) applies to all imported semi-automatic rifles capable of accepting military magazines, not just AKs. |
The links in that thread linking back to Arfcom are outdated and no longer work. Woody_in_MN, if you leave the MAK-90 in its original configuration, nothing needs to be done. If you wish to add a flash suppressor/muzzlebrake, bayonet lug, or a fixed or folding stock with pistol grip, you'll need to add US-made parts to be 922(r) compliant. You'll need 5 parts if the rifle will have a plain muzzle, 6 parts if it will have a muzzle attachment. |

There is a lot of speculation going on that to convert the MAC 90 to pistol grip configuation you DO NOT have to use any US made parts. The reason is the MAC 90 was already defined (Norinco, Mitchell, and Poly Technologies Avtomat Kalashnikovs [all models]) as an assult weapon proir to ban. (30) The term "semiautomatic assault weapon" means - (A) any of the firearms, or copies or duplicates of the firearms in any caliber, known as - (i) Norinco, Mitchell, and Poly Technologies Avtomat Kalashnikovs (all models); (ii) Action Arms Israeli Military Industries UZI and Galil; (iii) Beretta Ar70 (SC-70); (iv) Colt AR-15; (v) Fabrique National FN/FAL, FN/LAR, and FNC; (vi) SWD M-10, M-11, M-11/9, and M-12; (vii) Steyr AUG; (viii) INTRATEC TEC-9, TEC-DC9 and TEC-22; and (ix) revolving cylinder shotguns, such as (or similar to) the Street Sweeper and Striker 12; (B) a semiautomatic rifle that has an ability to accept a detachable magazine and has at least 2 of - (i) a folding or telescoping stock; (ii) a pistol grip that protrudes conspicuously beneath the action of the weapon; (iii) a bayonet mount; (iv) a flash suppressor or threaded barrel designed to accommodate a flash suppressor; and (v) a grenade launcher; (C) a semiautomatic pistol that has an ability to accept a detachable magazine and has at least 2 of - (i) an ammunition magazine that attaches to the pistol outside of the pistol grip; (ii) a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer; (iii) a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the nontrigger hand without being burned; (iv) a manufactured weight of 50 ounces or more when the pistol is unloaded; and (v) a semiautomatic version of an automatic firearm; and (D) a semiautomatic shotgun that has at least 2 of - (i) a folding or telescoping stock; (ii) a pistol grip that protrudes conspicuously beneath the action of the weapon; (iii) a fixed magazine capacity in excess of 5 rounds; and (iv) an ability to accept a detachable magazine. |
M4M: I know you know this, but just to clarify for the original poster - it's not about adding parts, it's about replacing foreign parts with US-made equivalents. |
Hmm... interesting. I suggest replacing the trigger group, and 3 more parts if you change the stock for a couple of reasons. First, the ATF has proven they interpret laws to favor themselves, and second, the stock triggers just plain suck |
I wish people would stop posting this. ![]() It just confuses people. It should only be debated in the Legal forum. There is NO Court Decision on this - and the ATF rule on Sporting weapons has NOT changed. My 2 cents - change your parts to US. and be Happy. |
