I'm ready to order a weaver classic 1-3x scope and mount it to a midwest side rail. Question is what rings will give me the lowest possible scope height without touching the side rail? I'm thinking warne low rings (.250) or do I need to go higher? The ocular diameter is 38mm. Thanks in advance.

It's gonna depend on scope positioning on the mount.  If you mount the scope further forward on the rail, the ocular housing of the scope will need to clear the rail.

I have that exact scope on an Arsenal SM-13 mount and had to go with medium (.38") Leupold rings to give the ocular housing the necessary clearance at the rear of the rail.  If the scope were to be mounted further back on the rifle, I could have gone with lower rings.  It all depends on the final positioning of the scope on the rail and what works for you as far as eye relief is concerned.

Pic below illustrates what I am talking about.  I have 1/16" clearance between the rear of the scope and the rail with the .38" Leopold rings.
