If I was to buy an upper like this:

http://www.spikestactical.com/z/index.php?main_page=popup_image&pID=301

Would I be able to swap this out with the already installed hand guard? ––>

http://www.spikestactical.com/z/index.php?main_page=popup_image&pID=83

Hence having an upper like this:

Thanks in advance.

Oh well that isn't the upper I am getting, it just has the same type handguard... basically I just didn't know if you can swap out the handguard for a Quad rail handguard.

yes, you can, but you will have to remove the front sight and delta ring. basicaly, you have to disasemble the upper and reassemble it with the ff rail handguard. there is a how to guide on installing ff rails at the top of the build it yourself section.

You can get the one in this link below and you don't have to take off the front sight its pretty easy, keeps the deta ring, tightens with allen screws and works great, real good instructions....

If you are wanting an SBR, you may want to check out the Class 3 Forum here on ARFCOM.

In a nutshell, you need to fill out an ATF form 1 which is an Application to Make and Register.  You will need to fill this out, have it signed by your local Chief Law Enforcement Officer.  You then take two sets of fingerprints, along with two passport photos, and a Certification of Compliance.  Mail all of this along with your check for $200 to ATF.  You then wait from 3-9 months or so for them to mail you your approved form.  During this time you will need to have your lower receiver marked with your name, city and state of residence, because you are the manufacturer of the Title II weapon.

This is all moot if you live in a state that does not allow SBRs.

you cant use that 10.5" barrel upper on a rifle lower without getting a stamp for a SBR. you can however use that upper on a pistol lower without any paperwork. if you do use that upper on a pistol lower and put a rail handguard on it then dont put a VFG on it or it will be an AOW (any other weapon). AOWs require paperwork as well.

in my opinion just get a 16" barrel  upper. its legal and still plenty short enough. or just make an illegal SBR and dont get cought. either way i wont be offended. i just want people to at least be aware that they are breaking stupid ass laws.

+ 1 what he said plus....
I made mine a pistol and then sent off for the stamp, Form 1 Individual and took 89 days.I got the stamp about jan 23rd this year,
I guess its what you like and intend to do with your AR. I have 20 inch, 16 inch and my 10.5 SBR for all types of shooting.I am kicking around a 6.8 SPC 16 inch build and want a suppressor too.
BRD is costly stuff.....

Oh gotcha! Yeah I'm planning on getting a 16" barrel. I got lost reading all of the laws there... I thought for a second that even if it is a 16" upper I still need to go through all that. I'm on the same page now. Thanks.
