Okay, I'm new to AR15.COM. I didn't find a FAQ that covers my questions, so here goes (bear with me): Is it legal to build a pre- or post-ban AR using a mix of the two generations of parts? If so, are there any restrictions to building one with more than what the law allows in terms of restrictions (e.g. bayonet lug, flash suppressor, etc)? Finally, what are some good links to check out in order to find said parts? Thanks for your answers. |

First, it would not be legal for you to "build" a pre-ban. In order to have a pre-ban the complete rifle must have been built prior to Sept 94. After that date the rifle, if sold, must be sold in pre-ban configuration or it looses its pre-ban status. If you have an actual, legal pre-ban then you can do about anything you want to it except convert it to an NFA weapon. Let's say, for example you found someone selling a pre-ban lower (there are some out there). Would it be legal for you to buy the lower and add an upper with bayo lug, flash supressor, etc? No, it would not because you did not buy a complete pre-ban rifle (lower and upper). If on the other hand you bought a complete pre-ban rifle and wished to change the upper to a post-ban upper that then would be legal, but would serve little purpose. On a post-ban weapon you can only have two "evil" features, such as a pistol grip and detachable mag, or a bayo lug and a pistol grip, etc etc. BTW there is a LEGAL Forum under Services> General Discussions |
