Looks like an Aimpoint M2 or ML2.

Its a bad angle, but it looks a cheap BSA to me.

The rubber strap is on the elevation turret is visible, the front lens area is threaded, and they are using an Aimpoint brand quick-release mount which costs more than a BSA.

That's a Aimpoint compM2 or compML2 with a Aimpoint QRP mount without spacer sitting on a Arms 38EX. You can see the writing printed on the bottom right side of the sight. Same place Aimpoint puts it. I've never seen a knock off with that writing.
