My friend and I found a small cache of 30 round mags at a local shop of $9.99 each. While going through the box of mags about 20% were marked LE or Military use only. I know that those are a big No-No. Of the ones remaining about 78% of them had dates stamped on them and the othere 2% were not stamped with anything. We bought all of the un-stamped ones. But my question is can I legally put a mag with a date stamp in either my pre or post ban rifles? I would imagine that I could put it in my pre but don't know about the post. Most of the dates were 8/02 on the mags. But I would assume that I can't. Most of the mags maked LE/Military or date stamped were 90%+ so I imagine that I can't or they would have been gone by now. Can anyone help. Thanks |

Yes and no. Many of the manufacturers started dating around 92 or so. Pre AW ban dated magazines should be fine. Ones with dates after the ban would be "technically" okay, as the law states that there is a presumption that the mag is grandfathered if it is not marked. Take that with a grain of salt, though. As many of the manufacturers who made USGI contract magazines failed to comply with the law, these are definitely post ban magazines that were improperly marked. They would likely be confiscated by LE if they came into contact with them, and could lead to prosecution. There is no ATF ruling that I know of on this as of yet. The other factor to consider is that these magazines are ALL going to be government contract mags, and since DRMO stopped surplus magazines a long time ago, any unmarked but dated post ban magazine like this would be presumed to be stolen government property, even if the person possessing them wasn't prosecuted for an AWB violation. I would stay far away. I picked up a few unmarked, dated mags like this, about the same way that you did. Upon realizing their true status, they were "donated" from my personal AR to my employer-provided M16 carbine, to go with the other legally possessed post-ban mags I have. I suggest you dispose of any non-compliant mags in a similar fashion, or return them to where you got them from, as long as they are an FFL holder and can legally possess them. |
