In addition to never doing business with that store again, my advise to you would be to reach back out to S&W, explain the situation and ask for a return label from them to send it in for service. If you're getting satisfaction then escalate to a manager either at the store or directly to S&W.

You have the legal right to return a purchase within 72 hours.

Go back to the store and insist they exchange the gun and ask S&W to send you and email stating it is not fine.

Make sure you document your attempt to get a refund within the 72 hours even if it is just bringing a friend to bear witness.

then tell us and everyone else what store this is so we know not to deal with them

6-8 weeks? I just returned a Sig 716 for repair. It took 10 days from when I shipped it to when I had it back all perfect.
Get a refund and buy a Sig 516

Yea, see if you can trade it back in for a SIG 516 or Adcor BEAR Rifle.

Which part are you talking about moving?  The gas block itself, or the piston over gas plug assembly, or the gas plug assembly loose inside the gas block?

Yea, that shouldn't be happening.  I thought the smith and wesson m&p licensed adam's arms piston system, but kind of weird they would change it to one pin?  Neither of my adams arms gas blocks moves at all, that's not normal.  They are rock solid and set screwed into a dimpled barrel.  

I know when people do the retrofit kits and don't quite install it perfectly, they run into issues with piston rods binding, bending and breaking, stuff like that.

If your M&P PSX has only (1) taper pin...then its the new design....altough it's an AA design, they have the okay to mod it to their liking. A couple of other things they did. They reinforced the adjustable gas plug dent plunger which is now captured by a roll pin as opposed to the original design of c-clip...they're using a dedicated Piston system upper with a .018" hole for the op rod as opposed to the bushing method, and they dropped the tail spring from the bolt and put the gas rings back on the bolt.

If I were you, I'd just call Smith ask for a call tag (tell them to email you a shipping label that you can print)...put the entire rifle (sans any add-ons you've put on it) back in the original plastic clam shell case and shipping box and send it back to them. If they can fix it...they will replace it. 100% Lifetime warranty.

Called S&W and they told me that I had to send it back to be fixed and that it was not suppose to move at all and that gas would blow out the sides because it was loose and not tightly sealed. So today I took it back to the store where I bought it and the owner helped me out. He gave me full credit back and let me pick out what I wanted I picked out A Sig 516 and it was $250 more but he gave it to me for the same price as the M&P15 psx. This Sig 516 is built a whole lot better the gas block has two pins in it. I'm sorry but I don't think I will ever buy another S&W again they are junk. I'm very happy with the way this one is built. Thank you all for your help.

Glad we as a bunch could help.

I have had 3 Sig ARs and they are great guns.
The first I put 3K+ rounds through it and a LE friend talked me out of it.

I have since bought another 516, this a Gen 2 and a Sig 716 (308).

The 716 had a problem and I sent it back to Sig on their dime and received it back ten days later fixed.
That is how it should be done.

However, IMO S&W makes a fine AR at least their DI guns. I have 2 and they are flawless. (3 if you count my MP15-22)

I would not have bought an AA clone piston so would not have considered the S&W piston when there are many true and tested designs like the Sig.

There will always be a hiccup with even the best makes even a Sig but their method of return, fix and back in your hands is one of the best in the business

That to me is both a comfort and a recommendation

Thank you so much for your help the Sig 516 is nice I can't wait to go shoot it this weekend. The clone AA piston system would be good if they just put two pins in the gas block to give it more support on the barrel. The owner at the store had another S&W M&P15 PSX on the shelf and he looked at that gas block and it was nice and tight no play at all. Well now I know what to look for next time.
