I think this would be legal but I wNt to check. I buy a stripped receiver. Then I build a pistol from it. Then if I want to make that pistol a rifle buy adding a stock and long barrel, I can no longer go back to a pistol with this receiver, or can I? Thanks. |

You can change the upper to a 16" barreled upper and add a stock to make it a rifle. You can take the stock off and change it back into a pistol. The key here is that you must have built it as a pistol FIRST. You can change a pistol to a rifle and back again to a pistol as many times as you want to. However, if the receiver was originally built into a rifle then, it is a rifle forever. You can not make a rifle into a pistol.
Now, basically this has to do with how the receiver was transferred. if it was transferred as a receiver you can build what you want from it. If it was transferred as a rifle, then you MUST build a rifle from it and it can never be a pistol. All stripped receivers should be transferred as 'other - receiver'. In Ca. though you would have to specify what it will be and have it transferred as such. In states where AR pistols are illegal receivers have to be transferred as long guns. |

yep- pistol > rifle > pistol again ok, reverse NOT ok...
as far as the ffl screwing up, I had the best one ever last year; guy wasn't going to transfer my Spike's Punisher stripped lower to me because huh? 'it has the picture for full-auto in the back position. It's a machine gun'. Then he writes rifle in the box!!!!! ![]() ![]() and never deal with him again |

Second, in California, you may only be able to build a stripped lower into a rifle, (a State law) but on the 4473 (a Federal form) a stripped lower would still be transferred as an "other." ETA: for clarifiaction: California State law the receiver must be declared on the DROS (dealer record of sale) as either a handgun or rifle, the only two choices. But this is still a state law, not Federal. This DROS is done in addition to the 4473, where the stripped lower would still be "other." |
