If I buy a stripped, never been built on lower in a private party sale (no paperwork)...
can I build a pistol on it?

You are probably better off having the documents from a dealer sale. Use the FTF lower to build a rifle.

Agreed...  The ATF doesn't care that the private seller gave you bad information.  If it's not virgin and you not knowing that fact build a pistol...you'll still have an illigal SBR in their eyes.
