I am sure this has been asked about 1000 times before but I can't find what I need on the search function. I have a Stag lower that has paperwork that says it is a pistol lower. Can the lower be built into a rifle? |
Wrong! If its listed as a stripped lower you can go back and forth, just like a Thompson Contender. If you 4473 a Contender frame as a pistol you can go back and forth from a pistol to a rifle as often as you want! The only issue in WI is you must be 21 to purchace a frame or receiver 4473'd as a handgun. Check local handgun laws. |
Other than the "Wrong!", what in your statement conflicts with my statement? If the stripped lower is originally used to build a pistol, it can later be switched to a rifle configuration (as long as the stock is never on the receiver while it is assembled with an upper that has a barrel shorter than 16") and back to a pistol configuration. If the stripped lower is originally used to build a rifle, that's all it can ever legally be (unless you file NFA paperwork). |

JPN, you are correct. First build, not paperwork, determines what the firearm is. First build as a rifle, it is a rifle from that point on and cannot be put into pistol configuration unless, as you said, you SBR it. First build a a pistol, THEN the TC rule applies and you can go to rife and back to pistol as much as you want. You buy a TC Contender or Encore pistol and you can convert to rifle. Buy a TC Contender or Encore carbine and you cannot convert to a pistol. The ATFE is VERY clear on that. The 4473 paperwork really does not determine what it is. If the 4473 says it is a rifle then according to the letter sent me by the ATFE you would have a hard time saying it was a pistol. Say it is a pistol or just a stripped lower then you can do your pistol thing, but even if it says pistol then the first build is a rifle, if anyone can prove that or you cannot prove it was first built into a pistol then you may be inviting trouble. |
