| how do i go about registering an AR15 lower for an SBR? I already have the 14.5 upper so i just need to register the lower. the thing is, there arent any class 3 dealers around where i live. i need help cause everyone i talk to has no idea what i need to do. i live in texas so i know i can have one, just dont know how to go about getting around the class 3 dealer part. |

First, if you have a lower and a 14.5" barreled upper together, you already have an illegal short barreled rifle. To legally register a lower you need to fill out an ATF form 1, which requires getting fingerprinted and photo'd, and you will also need the CLEO's signature for your area. Once you have 2 form 1's completed, send them off to the ATF office in Martinsburg, WVA along with a $200 check and wait for about a month until you are either approved or denied. If you are approved, then you have a legal SBR. You also need to have the lower engraved with your name city and state, because you would be "manufacturing" the SBR, hence the use of the form 1. OK, first off - you're already in trouble for having the short upper and an unregistered lower receiver. Read up here: www.ar15.com/forums/topic.html?b=6&f=22&t=199905 You don't need a dealer, but you DO need to know what you're getting into.

| You need to read the threads in the NFA section. You can forget about the hassle of pics, finger prints, and CLEO and just set up a trust. Use Quicken Willmaker and set up the trust, notarize it, fill out 2 copies of a form one, write a check to BATFE for $200. Send the copy of the trust, the two form 1s, and you $200 to the BATFE in VA. Wait about 30 days and get your stamp. This is of course if your state allows NFA restricted guns. |

and im sorry if this sounds stupid, but whats a trust? that seems like something id rather do because it sounds alot easier. and im also thinking about getting a suppressor for it as well. would it be the same process? also, could you give me alittle more info on this trust method. thanks guys |
| That is a very good thing. If I were you I would have the stripped lower transferred as a pistol, that way you could legally mate the upper and lower right then, and not have to get rid of the upper or worry about constructive intent issues. If you do this, make sure to get rid of the stock body before hand. |

first thing first. remove the upper and take it to a place where it will be safe!!! mom's house. a buddies. anyplace but in your home with your lower. this is randy weaver bad. DON'T let it spend another minute in your house. now that you have been warned you can fill out the proper paperwork and wait for the ATF to give you permition to build the gun. ed to say if you have an AR-15 rifle of any sort and the sub 16" upper you need to do the above. |

hk, he already posted that he doesn't even have the lower yet. trust method (how I did it) 1. Get quicken willmaker 2. Follow the instructions on the software. Really self explanatory, as it guides you through the steps 3. Once you have your trust set up, print it out. 4. Sign it and have it notorized 5. Make a copy of the Certification of Trust 6. Mail this in with your 2 form1's and $200 check. This saves the hassle of having to get fingerprinted and CLEO signoff everytime. Getting a suppressor would be the same, except unless you plan on making your own, you will use a form 4 to transfer a suppressor to you from someone else. |

A trust basically holds assets, property, or other items. In this case the trust owns the SBR and grants you access to it. The way the NFA reads, an individual can not own these restricted items unless the CLEO route. The only way around it is with a CLEO sign off, Corporation, LLC, or the Trust. The trust is the easiest and you can do it from home. The CLEO "Chief Law Enforcement Officer" is by far the toughest to get. I strongly suggest reading the NFA forums. I read daily for a few weeks before I even started the paperwork. Suppressor will work the same way. If you form the ABC Trust for your SBR you can also transfer the suppressor into the same the ABC Trust. The only difference in the process it with the SBR you fill out a form 1 and the ATF mails the stamp to you. The suppressor will be bought from a class III dealer (unless you are making it) and transferred to the trust on a form 4 which the dealer fills out. The stamp is sent to the dealer an you pick it up w/ the suppressor. |

Thanks for all the break downs... so you can do two SBR transactions with one $200 dollar check sent in on the same transaction? What about sending in form 1 paperwork for an sbr and form 4 paperwork for a suppressor at the same time, and paying only one $200 tax fee? Just trying to make sure i understand. And yes, im going to go read in the nfa section but this thread is already going... |
no. you pay a tax for each stamp. so you'd have 1 check for the SBR, one check for the can. |
No. Each NFA item you want requires a $200 stamp. You could send the both in at the same time, but it will require $400, because there are 2 NFA items you are wanting. |
| Two quick Q's. I have a MP5 clone that I had SBR'd, I havn't had it engraved stating that is is a SBR.......is that something that has to be done? Also I'm wanting to SBR one of my Rock Rivers, can I send the form1 to an instate BATF office or does it have to go to a specific office? Its been 4 years since I done my clone, don't remeber where I sent it too. Thanks. |
