I am looking at a 14.5 upper in EE.  I e-mailed the owner and ask if the A2 was permanently attached
so as not to be an SBR.  They advised it just parts and not an SBR until built into a weapon.  Can someone help me with this?

If it has a regular A2 FH then the barrel will still be under 16" overall length even if it is permanently attached.

You'll need a Phantom or other similar FH for a 14.5" barrel or an extended A2 FH.

I personally wouldn't buy it if the FH wasn't permanently attached to make it 16" OAL........whether or not it is technically illegal I can't say.

from what I recall it is legal till you atach it to a complete rifle.

They might be able to get you with that lunacy called constructive intent.  Use a phantom or vortex or even one of those extended A2 F/H'ers from Sabre Defense to bring it up to 16" oal...  I think you may even be able to add an extra washer and then perm attach to bring it to legal length...
