If it was made and sold by the manufacturer or a dealer before the ban, you are OK. Some will say you have to have proof that it was a complete rifle before the ban, but this is not completely accurate. As long as there is no proof (such as manufacturer's records) that it was nothing but a stripped receiver after the ban was passed, then the burden of proof lies with the BATF to prove it was not a complete rifle. If the receiver was sold before the ban, and there is no absolute proof that it was not a complete rifle before the ban, then you do not have to prove that it was. Again, the burden of proof lies on the prosecuting body. At this late date, if the receiver has a preban serial number per the manufacturer, I surely would not hesitate to put all the evil features on it. |

Damn, I just heard that civilians will not be able to build pre-ban type rifles out of current (todays) le marked lowers or post ban lowers. In other words, lowers are under the law that existed during its production. This seems like bs, but check out the response from Ocala Armory when I inquired about their LE lowers as I was interested in building an M4 type clone after 9/13 with it. But, by her use of the question mark shows she is not positive. Can anyone settle this once and for all????!!! "You would have to get that from BATF - it is my understanding that if the ban sunsets, they are going to require any gun to qualify for laws in effect at the date of manufacture?" |

True but.... Except for if you live in a state that has a STATE ban similar to the Federal ban that is about to expire. The State AW bans will not expire, so residents of those states are out of luck. |
