Well work called everyone in today to do a shake down of the facility. Well we found the usual stuff. But we have a Inmate that has been a problem from day one. The last eight months he has been caught with three bottles of "Hoouch", he has given the staff an extremly hard time. He has shaved his head into a Mohawk, and done many other things. We have done everything in the regs we can do. Took phone call, took the T.V., even put him in the hole for awhile. Nothing helps. Well I found two more bottles of "Hoouch" this morning. My NCOIC has left it up to me to deal with, I called JAG and told them everything. The Lt. Col. at JAG helped me go through the UCMJ and get every charge we could, even some I didn't know about. That charges total about 12 years if he got maxium sentenceing. The JAG said he could get 7 to 10 years with parole after 6. He said it would be quick and easy to charge him because of him already being confined, and having 3 Art. 15's prior to arriving at our facility. Here is the question that is picking my brain, the Inmate has 3 months left at our facility before he is free, should I charge him, which will force him to go to Leavenworth, or throw him in the hole for the next three months and just try to get him out of here? I know he will end up backin jail within a month after his realease. What do you guys think would be the appropriate action?


UPDATE : Well we had a come to jesus meeting with the Inmate and the Guards. Friday night he tried to stand up to one of the Guards. It was a bad idea on him, (the Guard is a Golden Gloves boxer) it turned out bad for the Inmate. After he recovers in the hospital from the peper spray and ASP beating, he will be transfered to Naval Brig Quantico, untill the time of trial. So he made his bed now he has to sleep in it.

Why spend the money housing the dirtbag. Just give him a bad conduct discharge and get rid of him.

He is already getting a BCD, after he serves his time in confinement. he is in confinement for lighting a couch on fire in a day room, at the dorms of his base.

damn...that's a tough call.  I only worked correctional custody, never the 'real' jail, but this guy sounds like a royal PITA.

You, I, and everyone else in the US Armed Forces--including your shitbag--volunteered.  We all knew after basic training that there are consequences for failing to perform our duties..even the little things like haircuts, shaving, etc.


If it were up to me, I'd throw the book at him, and hit him with everything--including hard time--it sounds like he's earned it.  He made numerous concious decisions to thumb his nose at the rules/regulations...do you really want to turn this guy over to the civilian sector?  I doubt he'd get much more than a year or 2, but it would be a long, hard year.

It sounds like he's using his shennanigans to get discharged faster, and by letting him ride, he gets what he wants instead of what's coming to him.

The JAG said when it comes to guys who are already confined and are on there way out with a BCD, they get hammered if it goes to trial. I was looking at the charge sheet and I noticed that commiting some the things while either already confined or to a law enforecment (MP) it carries a much stiffer penalty. Some of the charges are, Making contraband, possesing contraband, underage drinking, infulence of a minor, failuer to comply with dress and apperance, and a whole host of others. Just wondering if hanging this guy out to dry is the right thing to do?

Do you have prosecutorial discretion?
Given that his career in the military is over, and he will never be of any benefit to the military ever, process him out.  Prosecuting him does not help our armed forces at all.
Do you think some time at Levinworth will help rehabilitate him?  I'm under the impression that Levinworth isn't in that business.  He's a vandal, an undisciplined rebel.  If he were a serious felon I'd think differently.

Eh, ya know but that is just free advice on these here intarwebs.

I was a field\physical security MP, but I did get to work the road\desk once in a while.  It sounds like this dirtbag isn't violent twards the staff, and is getting the big chicken dinner anyway. I would hold off on charging him with addditional UCMJ because why should the Army pay to house his ass for the next 6-10 years? He'll probably end up on an episode of Cops inside of six months once he gets out. Save the hard time for hard cases.
