After seeing the abortion of a decision that Arizona v. Gant was, I'm curious as to what other SCOTUS rulings have negatively affected law enforcement. The other one that comes to mind immediately is KYLLO v. UNITED STATES, which said that police can't use a thermal imaging camera on the residence from the outside unless they have a warrant. I found that decision to be a load of bologna.

The ones you chose are miniscule. Each one has a way around it.
No way around Miranda, if you consider in custody interviews!! ETA- TN v. Garner- I have chased way too many people that could have been shot without that ruling
Both of those are way worse than the ones you chose! But, hey, so be it. We have survived with Miranda and Garner and still get the job done. Our state court removed SITA quite awhile ago for vehicles. |
