A friends' father gave him a Lugar.  He doesn't want to keep it.  He wants to give it to me.  Legally, is this possible?  A German weapon brought home from WWII, then given to me?

It may  be a stupid question, but I just don't know the answer.


BTW, I've tried to convince him to keep it, but he insists he doesn't want to keep it.  He is not a gun grabber, just not into firearms, oh well.

To do it legaly you would need to have it transfered on a 4473 form.  There are only a few conditions that handguns can be transfered between parties not using a 4473 and your's does not sound like one of the exceptions.

If you both live in the same state, and your state doesn't require anything special; he should be able to give it to you.

Parties in the same state, where the state does not require the use of a FFL dealer, seems like quite a few "conditions" to me.

The OP needs to check state law, but in the absence of a state law requirement, there is no federal law requirement for the 4473 transfer between residents of the same state.

Take the gun, buy him a beer and have a nice life. There is no paperwork on the gun now and no legal reason to start some.

Not true.  Most states allow a face to face transfer with no paperwork.  Check your local laws...

I think I'll pass on the Lugar.

Here is where it gets a bit sticky.  Right now, I live in NY(you can see why I'm asking questions), but I'm moving to NC next month.  My friend lives in PA.  I have a NY resident CCW and a Florida and PA non resident CCW.

I think once I move to NC, I'll ask a local FFL, see what he has to say.

I'm used to doing every handgun transaction through an FFL(NY).  This leads me to another question. I know in some states, handgun transaction do not require an FFL.  What if someone unknowingly buys a stolen weapon and uses it to defend himself?

Honest if he dont want it ,get ,it sounds like you are a more greatful owner of such a fine piece

A colt government a P08 (luger ) a Colt peacemaker is the three guns that to me just by the look is a nice real hand gun

when you get it ( damn you if you dont )  find a ammo that throws the casings 1 to 2 meters up in the air
Then by looking at the case notice the small triangular dent the case get on the case mouth
the dent should be as small a possible
If the casings fly to high or the dent is to deep ,then the ammo is cycling to fast
During the firing the locking action is very strong ,but when the action bottom out is when you can hurt the gun by to hot ammo

Sorry i cant help you with the legal stuff, only the gun ammo and such

Ps if you not already have shoot the gun ,then please only load two  round at first and be careful
Shoot it it that way a few times to make sure it dosnt double
If it goes fullauto it will be a strange feeling firing 8 rounds that way and if you dont hold on to it you might get hurt

Make damn sure its not loaded when taking it apart ,,it can fire a round that is in the chamber when only having the upper part at hand ,and this most often did happen to people when they did lay the thing on the table pointing the barrel to there stomach/ p,,,, chest

Ask him if he'll hold it till you move. Then he can ship it to a local FFL in your new state. Do the transfer and it's yours.

ETA Re Read and saw that person with luger is in different state. Didn't realize this. Transfer the gun in his state via FFL and you should be good to go.

That's not useful advice on a public forum.  I think anyone can figure out how to do something illegally without your help.  Figuring out how to do it properly is the purpose of good advice.

That's not useful advice on a public forum.  I think anyone can figure out how to do something illegally without your help.  Figuring out how to do it properly is the purpose of good advice.
There is no paperwork on the gun. Would you honestly feel like a bad person for accepting the gift? No paperwork, no way to trace the gun, no way for anyone to know he didn't get it from his grandpa, uncle whatever. I'm sorry I just think its kind of silly to pass up on such a historic item because you are afraid you might be breaking a law.

ETA But you're right he should get it transferred the right way, its not that difficult and no reason to pass up on such a nice weapon with such historic significance

That's the whole point of this thread, to find out if this is wrong or right legally.  It ain't my fault big brother watches over.  I just don't do well in prison.  I don't want the legality thing hanging over my head every time I'm transporting it to a range.

What date is the Erfurt Luger that he is giving you? If you want a practical view on this just take the gun and don't worry. "If" the ATF were to try to trace this gun it would be impossible. They would have to start at the Royal arsenal in Erfurt which was gone after WWI. Take it and then give me the serial number and let me know if it is all matching. If it is all matching I would caution against shooting it as any damage would render it about 50% value lost.

YEah my bad I didn't understand your situation fully. Here in AL we can give/sell pistols to one another w/o any paper work, btu across state lines we need an FFL. I thought it was an intrastate transfer at first. My bad.

FTF transfers of long guns are legal in NY between NY residents. FTF transfer of handguns are legal in NY between NY residents if both parties are NY pistol licensees or are exempt from the NY pistol licensing law.

Since your friend is not a NC resident the handgun must be shipped to a NC FFL for transfer after you become  a resident of NC.

Thats a nice piece even if the numbers are not matching ( but i would think they are )
Oil it god especially the barrel inside ( if hi did use some corrosive ammo )
keep it out of the holster ,it might course rust ( i am a bit over concerned but its really nice )

if you not have shoot a Luger you have to ,,its special
But if this one has matching numbers it is highly collectible keep it to be admired
Get one cheaper to shoot

Ps dont be surprised about how many people now will contact you trying to buy it from you  

Get in contact with some one who REALLY now the P08/Luger and let the one tell the stories
And show how it works (like a clock)
BUT DONT SELL IT
Of  coarse if you dont have this feeling for it then its ok to sell it ,but sell it to some one who wants it for keeping ,not trading

think of it when was you  born ,,you dad ,,your grand dad  

If you want to shoot it a few times get a spare extractor + a spare ejector and use them and keep the originals to preserve the matching numbers
It will properly be the most accurate 9mm you will ever shoot (the gun can do it ,,can you )

I have let more than a few Americans shoot mine ,and all was impressed
Ok mine does have a tuned trigger but the rest is stock
No matching numbers but its for shooting so its ok
