I have an employee who can't drive any of the company vehicles because of a DUI on his DMV record (Department of motor vehicles here in CA).He's a good worker and he wants more responsibility, but I can't make him a lead if he has to chauffeured around town in the work trucks. He's says he's going to try and get it expunged, but is that possible? If so how old does it have to be? Thanks SA |

There is more to the story than that...... DMV is separate from the courts (usually). The state requirements for DUI revocation must still be active and that is why he can't drive. The DMV usually starts their revocation time way before the courts get into it..... now, you can delay it through hearings, but DMV is quicker than them bogged down courts. How old is his DUI??? If it is more than a year and he is stil revoked, he either has a felony or repeatedly was caught driving after he was initially revoked. |
It's been two years, but it's still on his DMV, which makes the insurance murder if we make him a listed insured. We have to list him on the policy or else the coverage isn't the full amount of the policy, which would be foolish to risk. After some seaching and HUGE amounts of help from GD, i've found that he must wait the full three years in CA for it to drop off his DMV, and then we can insure him. As far as the expunging of his record, that would only make him look better for future employers or loans. Thanks ALL! SA |
DUI's in Kommiefornia hang on your record 10 years, as most commercal drivers need an 'aged' driving record. Some companies will touch you at 3 years + but really nail you for rates. How old is this employee as if he was under 25 with his DUI I can understand why an insurence company doesn't want to touch him. Expunging a record starts at about 2 grand and goes up depending upon how many courts are involved. A judge issues the expungment so the further back it is on a persons history the easier it is to get expunged. 2 years since a DUI would not have much of a chance. 10+ years are much better. |
