Is it legal to gift a handgun or rifle to a family member or anyone else for that matter if they live in a different state?  Or does this have to go through an FFL in the recipients state?  Thanks for the help.

Legally, it has to be transferred through an FFL in the recipient's home state.  I don't think BATF spends a lot of time checking on these types of transactions, expecially when the transfer takes place face to face.

If the firearm is used in crime and they trace it, soemone can/will get in trouble.  Not worth chancing it.  Do it by the book and nothing to worry about.

I know of a similiar case and a lot of money was spent on lawyers...

if it's from your father to you I doubt very much a jury would convict you on it. What happens if your father is no longer around.... how would be transfer them to you legally. See the problem with this one? No one will convict you. Now if you give it to a buddy that's another story.

All it takes is an enemy who wants to get someone in trouble, someone bucking for a promotion and it can happen...

Note that if it is part of an estate, then different rules at the federal level can apply...

Thanks for the help guys.  I'm going to get a Garand for my Step-Dad.  It will be a gift, I just wanted to check on the legalities, its been a while since I looked them up.  No problem bringing a Garand into CA is there?  Fixed mag and all.
