I posted this in team and it was suggested I put it here instead.



My divorce is final, as per advice gotten here, I didn't sign the quit claim because she hasn't gotten her refi yet. I have 2 days left until I have to sign it, she still has not refied yet. What will happen with this if she keeps spinning her wheels?

Not enough information.  Does the property settlement agreement require her to refinance?  Is the property settlement agreement entered as a court order?

quit claim does not remove you from current mort.  I assume you want her to refinance so your name is not on new mortgage?  What does the settlement say about the quit claim?  Must you sign it by a date certain, or is there a stipulation related to the refi?

You should be talking to your divorce attorney, that's why you have one.  If the refi is required by the agreement, look in the agreement for the clause that required the defaulting party to pay all legal costs necessary to enforce the agreement.

ianal but in my best opinion it all depends on if the the judge makes a ruling on if your ex-wife has 2 refiance..
