So in 2005 i earned very little money in missouri because i live and work in ks.  we did our taxes sent them the money that we owed and called it a day.  at some point they decided we owed them more money because they lost some of the information (we don't).  now they withheld the money we 'owed' from the our 2009 return.  so, they are stealing because they can.  other than contacting the person that i corresponded with (who told me everything was taken care of and that i didn't owe them money) what can i do?  send an attorney after them for harassment?  send them bills for fees and penalties?  call a local call for action team from one of the local news channels (i hate these people but if they could be used i am not above it)?  any ideas would be appreciated because i'm feeling a little postal and i don't know how to get my money from them.

Who is "they" ?  Your title suggest the IRS but your question refers to states.

Secondly, the IRS and state tax depts cannot be sued for "harrassment" just for collecting taxes.

they aren't just collecting taxes.  they are stealing money that doesn't belong to the government.

they aren't just collecting taxes.  they are stealing money that doesn't belong to the government.


There is an appeal process for disputing tax assessments from the IRS.  If you dispute the amount assessed, you should use that process, not complain about the supposed conduct of the IRS.

It is technically the missouri department of revenue so I don't know that the appeals process does me any good and it isn't supposed conduct.  I paid them and then they withheld more from what was suppose to be a return.  plain and simple.  thanks for the link I will check it out.

If the state levied against an IRS refund, the IRS does not have the money, the state does.

The IRS is not going to return money it took at the request of the state.

There is usually plenty of notice before refunds get seized.

Yeah I responded.  Every time they ask for something I send it.  I was told that it was done in writing from someone in the revenue department for the state.  Then, when we got our refund with the letter telling us why it was short I emailed the lady to ask what was going on.  Now, they want me to send in my W-2's.  It is such a pain in the ass.  If they were competent enough to do their job and not lose documents they would have had the W-2's on file.  I can't wait for government run healthcare.  It should run real smoothly!
