eta, people lie like hell all the time too. In a perfect world, I have a problem with it. In our world, if a cop claims they have evidence proving something and it causes a guilty person to confess, no issue.  If someone confesses to a crime they didn't commit because a cop says they have proof, then that's darwin at work and I have no sympathy.

As a former police officer. 95% of the people i locked up would not be in jail if they shut their mouths. You can warn someone over and over and they would still talk themselves into a confession.

Or so I've been told........

Many of them like to threaten you with things they can't make good on.
It's really pisses them off when you don't fall of it.

Additionally, how many of us lie when we tell the salesman that we can "get it cheaper elsewhere", or to the officer when we say "why, no, I had no idea I was going that fast", to our boss when we're suffering from work stress but say we have the flu, or to any other number of people?

One of my L.E. instructors told us if/when we are ever around a "suspect" to take our note pad out and just start doodling, but don't say what you are writing, and you'll be amazed what the "suspect" starts saying.

It's the oldest trick in the book... Tell the guy you have evidence that he did it when you don't...

And it works to get the bad guys to confess...

So I don't see a problem with it....

Remember,,,you have THE RIGHT to remain silent.

Because officer friendly WILL use EVERYTHING that you say against you...

And that is how mentally feeble people have ended up in jail. And in some areas, notably, cough cough, The South, they often go to prison because it's never caught in the courts (or the prosecutor lies, which seems to happen on occasion as well).

Watch that show "Another 48 Hours" and see how many times the guy that everyone knows is guilty gets away just because he doesn't confess. Hell, even with his best friend saying he did it he still gets away.

The problem is when someone confesses to "get a deal" the cops hint he can get when they are claiming they have evidence.

I.E. The usual we know you did it, your buddy is in the other room the first one to talk gets the deal....

A smart innocent man would continue to deny it, but I can see where a guy who isn't a complete retard might figure... Well confess, & plead guilty and get 5 yrs for a crime I didn't do, or fight it and likely lose and get 20.

My dad knows someone in the FBI that gave him pretty much the same advice.  If the cops come to question you about something NEVER talk unless they absolutely, 100% prove to you that you are not a suspect but a witness.  Even then make sure you have a lawyer present to go over everything with before the questioning, and then present during the questioning.  Until then the only words out of your mouth should be "I would like to call my lawyer."

That is a not correct, because even once I am present my client still will never talk unless we have a signed agreement providing my client with full immunity





What my client admits too becomes admissible in court against him.  Nothing that he says that is exculpatory can be used to benefit him because it is hearsay.  If your lawyer agrees to let you talk to the police as long as he is present I would seriously consider firing said lawyer and hiring someone who didn't figure out how to defend a case from watching Ally McBeal.
