i'm not clear on gun laws . if i get a gun today that fits the description below , and a weapons ban is enacted tomorrow , would i have to change my gun to make it legal , or would it not apply to me ?








The Federal Assault Weapons Ban prohibited the sale to civilians of certain semi-automatic firearms

The ban only applied to weapons manufactured after the date of the ban's enactment



Semi-automatic RIFLE able to accept detachable magazines and two or more of the following:
Folding or telescoping stock
Pistol grip
Bayonet mount
Flash suppressor, or threaded barrel designed to accommodate one
Grenade launcher (more precisely, a muzzle device which enables the launching or firing of rifle grenades)

Semi-automatic PISTOL with detachable magazines and two or more of the following:
Magazine that attaches outside the pistol grip
Threaded barrel to attach barrel extender, flash suppressor, handgrip, or suppressor
Barrel shroud that can be used as a hand-hold
Unloaded weight of 50 oz (1.4 kg) or more
A semi-automatic version of an automatic firearm

Semi-automatic SHOTGUN with two or more of the following:
Folding or telescoping stock
Pistol grip
Fixed capacity of more than 5 rounds
Detachable magazine

There is no way to know what the provisions of the bill (and possibly subsequent law) would say.


In other words, it doesn't have to read just like the old one did, so there's no way to answer this question

It could be the same, or it could say that you can't own a black rifle if you live within 300 miles of a donkey-rapist. Who knows

Depends on the kind of ban.  It wouldn't surprise me if "they" thought up something that'd require any weapon fitting that description to be turned in to your local ATF branch.

No one knows what the next ban will be like.  If it has a grandfather provision then you will not have to change anything aquired prior to the ban.  If no grandfather provision is included, then you will have to change the weapon, or more like they will become illegal...

The ultimate response would be, just buy what-ever the hell you want and don't worry about it. People worry too much, not good for you.

If they ban, they ban....worry about what to do then.

the reason im asking is im thinking of buying a saiga 12 shotgun but if a law can be passed that says you cant have a shotgun with a detachable magazine then i'll just get a tube magazine shotgun instead

This. The current congressional regime has shown enough of a "we can do what we want" attitude that it makes me think they'd be willing to pass something blatantly unconsitutional and simply wait for it to go to SCOTUS to accept defeat.



Of course, it's a good thing we have Republicans to stand up against such things, right? See MCain-Feingold for answer.

"as long as it passes Constitutional muster"

It's quite hard to ban a already legal product and make it illegal, especially without compensation.

If you purchased a firearm fitting that description on Sept 10th 1994, and the law went into effect Sept 14 1994, you would NOT have to change the appearance of the firearm.

As the red highlight states: the law only applied to firearms manufactured AFTER the date.

Welcome to the site. We all just have to wait and see what happens. This topic has been covered over and over, so that is why your getting the "face palm" response. But htis is a great forum and good people, so it can be a valuable tool in (one of many you should be using) keeping up with developements on various legislation. alot of good info here.
