Technically if you buy a gun for someone as a christmas gift does that = a straw purchase?   just wondering how this works, I recieved several as a kid from my parents and the season got me thinking about it.  what say you

ETA: Assuming no STATE law prohibiting it, and of course no crossing state lines in the gift transaction.

If it is a kid, buy the gun yourself in your name and give it to them.

My FIL went to prison back in the 70s and I didn't know this until after few years of knowing him. Does the felony thing ever expire?

It is completely legal to purchase a firearm with the intention of giving it away as a gift.


It is quite a different matter to give a felon a firearm, always a no-no.

Once a felon, felon for life



While true that he will always be a felon because he once committed a felony.  Some states have a procedure by which a convicted felon can petition and have his rights restored under certain circumstances.

Maybe legal maybe illegal depends on several variable, technically you can't give a child ownership of a gun. You also can't legally give a gun to a resident of another state with out an FFL transfer.
Also some states have laws regarding private transfers so it could depend on where you live.

they give you the money=they're the actual purchaser and the question on the 4473 is "are you the actual purchaser?"

also, important note 1 on page 3 says if it's a legitimate gift it's ok

Wrong.

If you buy a gun for someone, not as a gift, and that person can legally own it, it's still a strawman.
